SILVERTHOUGHT ONLINE TERMS:

Silverthought Online purchases one-time nonexclusive electronic rights for works we accept (and nonexclusive electronic reprint rights for reprints we accept). All work published by ST Online remains solely the property of the original author. Writers may withdraw submissions from the ST Archive at any time for any reason, but please allow up to 30 days for removal of your work from Silverthought.

Submissions to Silverthought remain the sole property of the author, with all rights intact, including the right to withdraw the piece for any reason with sufficient notice. All submissions to the Online and Print divisions are kept in the strictest confidence and our interns operate under binding Non-Disclosure Agreements.


SILVERTHOUGHT ONLINE COMPENSATION:

  • micro (up to 100 words): $2.00
  • flash (100 - 1000 words): $5.00
  • short (1000 - 20000 words): $20.00
  • novella (20000 - 50000 words): $50.00

Compensation is via PayPal and is disbursed mid-month within 30 days of publication on ST Online. Compensation is non-transferable. These compensation rates do not apply to any work that appeared on ST Online before 10/01/2010.



SILVERTHOUGHT PRINT COMPENSATION:

Print publications (novels and single-author collections) are contracted and paid as a percentage of profits from sale. We currently do not offer advances on royalties. Email the editor for further print contract details.

We occasionally assemble print anthologies of pieces that appear on the site; further guidelines will be provided to writers whose work we'd like to include in a collection and these will be additionally compensated for print rights under a separate contract from our Print division.

1) These are the terms and conditions for use of the Silverthought website (www.silverthought.com) and affiliated sites or web pages that are operated by Paul Hughes. These terms and conditions apply whenever you access www.silverthought.com on any device.

By using this website, you agree to be legally bound by these terms, which shall take effect immediately on your first use of the site. If you do not agree to be legally bound by all the following terms, please do not access and/or use the Silverthought website.

Any changes we make to the Terms and Conditions will be reflected on this page.

2) Entertainment purposes only
This website provides information of an entertainment nature, including short stories, serialized fiction, sample chapters of novels, full novelizations, collaborative writing projects, and flash fiction. Silverthought does not accept any liability for your use of or interpretation of the information contained on this website. Silverthought shall use its reasonable endeavors to ensure that the information contained on the website is accurate and up to date. Silverthought may make improvements or changes in the information, services, products, and other materials on this website, or terminate this website, at any time without notice.

3) Use of material appearing on Silverthought
For the purposes of this agreement, "material" means written text or graphics published on the Silverthought website, whether copyright Silverthought/Paul Hughes or a third party.

You may download and print extracts from the material and make copies of these for your own personal and non-commercial use only. You also agree not to adapt, alter, or create a derivative work from any Silverthought content except for your own personal, non-commercial use. You are not allowed to download or print the material, or extracts from it, in a systematic or regular manner or otherwise so as to create a database in electronic or paper form comprising all or part of the material appearing on the Silverthought website.

You may not reproduce any part of the Silverthought website, or transmit it to or store it in any other website without a prior agreement in writing from the Silverthought owner (Paul Hughes), who can be contacted by email at editor@silverthought.com.

4) Limitation of Liability
To the maximum extent permitted by law, Silverthought disclaims all express and implied warranties with regard to the information, services, and materials contained on this website. You must not rely on any statement we have published on the Silverthought website without first taking specialist professional advice.

For the avoidance of confusion, we will not be liable for any damages arising as a result of your use of this website, or any loss caused as a result of your doing, or not doing, anything as a result of viewing or reading the material or any part of it.

We give no warranties of any kind concerning the Silverthought website or the material published on it. We do not warrant that functions contained at this website will be uninterrupted or error-free or that defects will be corrected. We do not warrant that the Silverthought website or any of its contents is virus free (although we endeavor to ensure that this is so). You must take your own precautions in this respect, as we accept no responsibility for any infection by virus or other contamination or by anything that has destructive properties.

5) Links to other websites
This website contains links to other websites that are independent of Silverthought and are maintained by third parties. Silverthought is not responsible for the content of any third-party websites and shall not be liable for any damages or injury arising from the contents of such websites. Any links to other websites are provided as a convenience to you as a user of this website and do not imply Silverthought's endorsement of the linked websites or association with their operators.

6) Jurisdictional issues
This website is controlled and operated by Silverthought from its offices in Evans Mills, NY. Silverthought makes no representation that materials on the website are appropriate or available for use in other locations. Those who choose to access this website from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.

7) Variations
These terms may be varied from time to time. Please ensure that you review these terms and conditions regularly, as you will be deemed to have accepted a variation if you continue to use the site after it has been posted.

 

PUBLISHING TERMS AND CONDITIONS:

By submitting content to the Silverthought website, you are deemed to have accepted these terms and conditions:

1) Your Copyright
Any content submitted to the Silverthought site remains the intellectual property of the author or copyright holder (you may re-publish your content or adaptations of your content elsewhere). However, by submitting content to the Silverthought website, you grant permission for Silverthought to publish your content on the Silverthought website and to modify, adapt, edit, reproduce and create derivative works based on your content (for example, to publish an excerpt in Silverthought email newsletters or press releases), without payment to the author or copyright holder, in perpetuity. (See disclaimer below.)

2) Libel
To the maximum extent permitted by law, Silverthought holds the author or copyright holder responsible for any defamatory or libellous remarks made in the content they submit. Libel means to defame or take away a good name. Libel can be proven even when the plaintiff is referred to indirectly. The tests of defamation include: hatred, ridicule or contempt; causing the subject to be shunned or avoided; 'lowering a person in the estimation of right-minded people'; and implying a lack of qualification, knowledge, skill, capacity, judgment or efficiency to conduct business. Malicious falsehood means the publication of a false statement that damages a person. In criminal defamatory libel one publication could be the subject of both civil and criminal proceedings and the defamer could be made to pay damages.

3) Disclaimer
Where you are invited to submit any contribution to Silverthought (including any text or graphics) you agree, by submitting your contribution, to grant Silverthought a one-time non-exclusive electronic (or non-exclusive reprint) right and license to publish your contribution on the Silverthought website. If you do not want to grant to Silverthought the rights set out above, please do not submit your material to Silverthought.

In addition:

i) Where you are invited to submit any contribution to Silverthought (including any text or graphics) you warrant that your contribution:

ii) is your own original work and that you have the right to make it available to Silverthought for publication on the Silverthought website and other purposes outlined above; and

iii) is not defamatory; and

iv) does not infringe any law; and

v) you indemnify Silverthought/Paul Hughes against all legal fees, damages and other expenses that may be incurred by Silverthought/Paul Hughes as a result of your breach of the above warranty.

4) Removal of content
Silverthought has the right to remove content from the Silverthought website at any time without advance notice or explanation.

Silverthought is not legally bound to remove content that is published on the Silverthought website at the request of the author or copyright holder. However, it is our policy to do so; if you would like your content to be removed from the Silverthought website, please email editor@silverthought.com, with a note explaining the reasons for your request, and every attempt will be made to remove the content as soon as possible.

 

PRIVACY POLICY:

Silverthought is committed to ensuring the protection of personal information of our staff, customers, clients, and users of this web site. We are committed to keeping personal information accurate, confidential, secure, and private.

Silverthought collects personal information about you only when you knowingly and willingly provide it, and we will not share or otherwise profit from the distribution of personal data beyond the use it was provided to fulfill.

1) Collection of Personal Information
Currently Silverthought collects personal information from users when they register for our forum, make a purchase from our bookstore, or when they contact us directly.

Forum
When an individual registers for our forum they are required to provide their name, email address, and password. This information allows us to deliver services to them in a secure manner and enables them to change their preferences associated with the forum. We also ask subscribers for additional information, which is not required to participate in the forum. The purpose of gathering this optional information is twofold: 1) With a greater understanding of our users we can develop services even better suited to the needs of our community and 2) to generate a statistical profile of all community members that is shared with users of said forum. Note that Silverthought will not sell to or share your email address or individual information with any third party.

When a forum user cancels his or her membership, that individual's personal information (name and email address) will be deleted from our membership database. Any posts the user has elected to make, however, will still have the personal information they provided displayed. This is to ensure accountability for all content on our forum. If a user wishes to delete their posts, they may do so before canceling their membership.

Bookstore
When a visitor makes a purchase from the Silverthought bookstore, our third-party merchant service provider (PayPal) collects personal information in order to validate billing. Of this information, email address, name, and shipping address are made available to Silverthought. This information is used to verify the buyer's identity and to resolve delinquent accounts.

Email
When you send us an email you provide us with your name and email address, along with any other information you provide in the body of your email. This information may be shared with persons outside of Silverthought only when they are required to receive this information in order to respond effectively to your query. We retain all email correspondence indefinitely in order to improve our services according to customer feedback.

2) Limitation of Liability
Complete confidentiality and security is not possible over the Internet. Internet use and communication is subject to interception, loss, and alteration. On whichever site you provide personal information, it is possible for a third party to view that information. You acknowledge and agree that Silverthought shall not be responsible for any damages you may suffer as a result of the transmission of confidential or sensitive information over the Internet, and that all such communications will be at your own risk.
